Defense Ministry’s Surprise Lawsuit against TV Formula Founder May Threaten its Functioning

Just two days prior to the election, the Ministry of Defense of Georgia filed a lawsuit against the owner and founder of Formula TV, Davit Kezerashvili which may threaten the TV’s functioning.

The Ministry is seeking €5 million in, as it claims, “damages” in a case in which the Supreme Court issued a guilty verdict a few weeks ago and thus reversed Mr. Kezerashvili’s earlier acquittal in Tbilisi City and Tbilisi Appeals courts.

Shalva Tadumadze, a former Prosecutor General and former personal lawyer to Bidzina Ivanishvili - now a Supreme Court judge - deliberated on the case which he pursued and lost while prosecutor against David Kezerashvili. The case is widely regarded as an example of politicized justice and a pressure on the critical media.

On September 7, the Supreme Court of Georgia sentenced Davit Kezerashvili to 5 years in prison in absentia, being the first guilty verdict against Davit Kezerashvili.

The Supreme Court began hearing the case almost two months after PM Irakli Garibashvili threatened Formula TV founder and the former Defence Minister, David Kezerashvili with judicial proceedings.

Today, he also responded to a new lawsuit. According to Garibashvili, there are many similar cases of embezzlement and the investigation "will respond to all the facts."
